NAI in the News: Defining Dark Patterns

NAI Counsel for Compliance and Policy Ryan Smith authored an article in the May 2023 edition of the TechReg Chronicle on defining dark patterns and examining FTC enforcement actions to determine best practices. Analyzing recent FTC enforcement actions against Epic Games, Inc., and Vonage Holdings Corp., the article examines past FTC actions and looks for ways to both define dark patterns and how to avoid them. The NAI has previously provided member updates on dark patterns, including an analysis on the FTC’s 2022 Staff Report “Bringing Dark Patterns to Light.” We also offer member guidance on best practices for user choice and transparency to assist members in avoiding dark patterns.
